Bring Your Love to Canada: Spousal Sponsorship Made Easy
Spousal sponsorship allows Canadian citizens and permanent residents to sponsor their spouse (legally married) or common-law partner (living together in a conjugal relationship for at least 1 year) for permanent residence in Canada. This program allows families to reunite and build a life together in Canada. Our comprehensive services are designed to support couples in navigating the complexities of the Spouse or Common-Law Partner Sponsorship process, ensuring a smooth and successful journey toward living together in Canada. Our expertise extends to both in-Canada and out-of-Canada applications, catering to diverse needs with personalized attention.
Types of Spouse Sponsorship
Two major types of spousal sponsorship are:
Inland Spousal Sponsorship: This applies when the spouse or partner being sponsored is already in Canada legally, on a valid temporary resident status such as a work permit, study permit, or visitor visa. The couple must prove that they are living together in a genuine relationship. During the application process, the applicant can also apply for an open work permit, allowing them to work in Canada while their application is being processed.
Outland Spousal Sponsorship: This applies when the spouse or partner being sponsored is outside Canada. Although the couple must still prove that their relationship is genuine, they do not need to demonstrate that they are living together at the time of application.
Who Can Be Sponsored?
- Spouse: Must be legally married to you, of any sex, and at least 18 years old.
- Common-Law Partner: Not legally married to you, can be of any sex, at least 18 years old, and has cohabited with you continuously for at least 12 months in a conjugal relationship, with any separations being short and temporary.
- Conjugal Partner: Not legally married or in a common-law relationship with you, can be of any sex, at least 18 years old, in a conjugal relationship with you for at least 1 year, resides outside Canada, and is unable to cohabit with or marry you due to significant legal and immigration barriers, such as marital status, sexual orientation, or persecution based on religious or social grounds.
Eligibility Criteria for Sponsoring in Canada
Essential Eligibility Requirements for Sponsoring Family in Canada are:
- Must be at least 18 years old.
- Must be a Canadian citizen, permanent resident, or registered under the Canadian Indian Act.
- Canadian citizens living abroad must intend to return to Canada with their sponsored family members.
- Permanent residents residing outside Canada are ineligible to sponsor.
- Must demonstrate financial self-sufficiency and not be reliant on social assistance, except for disability reasons.
Sponsorship Agreement
The sponsorship agreement is a crucial component of the Spousal Sponsorship application process in Canada, outlining the responsibilities and obligations of the sponsor when sponsoring a spouse or partner for permanent residency. Key elements and responsibilities of the sponsorship agreement include:
- Financial Support: The sponsor commits to providing financial support for the sponsored spouse or partner, covering basic needs like food, shelter, clothing, healthcare, and other essentials.
- Duration of Agreement: Typically lasting three years from the sponsored person’s date of becoming a permanent resident, this obligation persists even in the event of relationship changes such as divorce or separation during this period.
- Repayment of Social Assistance: If the sponsored individual receives social assistance during the agreement’s duration, the sponsor is required to repay the government for those benefits.
- No Reliance on Social Assistance: The sponsor ensures that the sponsored spouse or partner does not need to rely on social assistance. Should the sponsored person receive such assistance, the sponsor is obligated to repay the government.
- Agreement with Province or Territory: The sponsor agrees that the sponsored person will reside in a Canadian province or territory where sponsorship eligibility applies. For sponsors residing in Quebec, additional compliance with Quebec’s sponsorship requirements is necessary.
