Spousal Work Permit
If you’re studying or working in Canada on a valid permit, your spouse or common-law partner may be eligible to apply for an open work permit. This type of work permit allows your spouse or partner to work for any employer in Canada without the need for a confirmed job offer. To qualify for an open work permit, your spouse or partner must demonstrate that you are studying or working in Canada and provide evidence of their relationship with you.
Spouse Open Work Permit Canada Requirements
The IRCC has stipulated that open work permits will be limited to spouses of international students enrolled in master’s and doctoral programs. Regrettably, spouses of international students in other levels of study, such as undergraduate and college programs, will no longer qualify for open work permits.
To be eligible for sponsorship, you and your foreign spouse or partner must demonstrate that you are in a genuine relationship falling under one of these three categories:
- Spouse: Legally married.
- Common-law partner: Living together or having lived together for at least 12 consecutive months in a marriage-like relationship.
- Conjugal partner: In a committed relationship for at least 12 months, facing significant barriers preventing cohabitation (such as cultural, religious, or immigration obstacles).
Your spouse or common-law partner may qualify for an open work permit if you meet the following criteria:
- You hold a valid study permit.
- You are eligible for a post-graduation work permit (PGWP).
- You are enrolled as a full-time student at one of the following types of institutions:
- A public post-secondary school (e.g., college or university) or CEGEP in Quebec.
- A private college-level school in Quebec.
- A Canadian private school authorized to grant degrees under provincial law (e.g., Bachelors, Masters, or Doctorate).
The open work permit issued to your spouse or common-law partner will have the same duration as your study permit.
